Two Fifty Site

Terms of Service

Effective October 8, 2026

These Terms and Conditions govern your use of the website design, build, hosting support and lead follow-up services provided by Two Fifty Site. Please read them carefully. By submitting a request, approving a mockup, paying a fee or opting in to text messages, you agree to these Terms.

1. Acceptance of these terms

Two Fifty Site (“we,” “us,” “our”) is a web design agency. These Terms form a binding agreement between you (the individual or business entity using our services, “you” or “Client”) and Two Fifty Site. If you are agreeing on behalf of a business, you confirm that you have the authority to bind that business.

If you do not agree with any part of these Terms, do not use our services, submit a request form, or opt in to our text messages.

2. Our services

We offer two services:

  • Website Only — a single-page business website built for a flat one-time fee of $250 US, delivered after you approve a free mockup.
  • Monthly Growth Plan “ a website plus an ongoing lead follow-up and review-request system, for a $197 US setup fee and $197 US per month.

We also provide related work reasonably connected to those services: domain and hosting guidance, content placement, contact and click-to-call setup, enquiry capture, and text message follow-up on your behalf where you have asked for it.

3. Scope of work

Each project begins with a written summary of what will be built: the pages or sections included, the features requested, the content you are supplying, and the target launch date. That summary, together with these Terms, is the full scope of the project.

Work that falls outside the agreed scope — additional pages, custom functionality, e-commerce, copywriting, photography, logo design, ongoing content edits beyond the included revisions, or management of third-party accounts — is quoted separately and only starts once you approve the additional cost in writing.

Our standard delivery target is a mockup within 24 hours of receiving your details and a live site within 48 hours of your approval and payment. That target assumes you supply content and access promptly; delays on your side, or delays by a domain registrar or hosting provider, move the launch date accordingly.

4. Free mockup, approval and revisions

We prepare a mockup of your homepage at no cost and with no obligation. Nothing is charged until you approve that design. Approval may be given by email, text message, or by payment, and once given it confirms the scope and the price.

Reasonable text, image and colour adjustments are included before launch. After launch, further changes are handled under the Monthly Growth Plan or quoted as one-off work.

5. Client responsibilities and materials

You agree to:

  • Provide accurate business information, text, images and contact details in a timely manner;
  • Own or hold the rights to everything you supply, and keep third-party assets licensed for use on your site;
  • Make sure the content you supply is truthful, not deceptive, and complies with the laws and licensing rules that apply to your trade;
  • Keep your billing details current and respond to our requests within a reasonable time.

Where we supply stock imagery, fonts or placeholder text on your behalf, those items are licensed for use on your project only and remain subject to their own provider terms.

6. Payment

Website Only is a flat $250 US, invoiced once you approve the mockup and due before the site goes live. The Monthly Growth Plan is a $197 US setup fee due on approval, followed by $197 US per month billed in advance on your start-date anniversary each month.

All amounts are in US dollars and are exclusive of any sales tax, use tax or similar charge that applies to you. Invoices are payable within 7 days. We may pause work, or take a site offline, if an invoice becomes more than 14 days overdue, and we may add a late charge of 1.5% per month on overdue balances where the law allows.

Because each project is bespoke and the mockup is reviewed before any payment, all fees already earned are non-refundable. If a delivered site does not match the approved mockup, our remedy is to correct it at no charge.

7. Recurring billing, cancellation and suspension

The Monthly Growth Plan continues until cancelled. Either party may cancel a monthly plan by giving at least 30 days written notice; access and services continue to the end of the paid period. Website Only has no recurring charge and no cancellation requirement.

We may suspend services for non-payment, for a breach of these Terms, or where we reasonably believe your site or messaging exposes us to legal or security risk.

8. Domain names, hosting and third-party accounts

Your domain name and hosting are your property and your responsibility, even where we help you register, point or configure them. Third-party providers set their own prices and terms, which can change at their discretion. We are not responsible for the acts, outages, data loss, account suspensions or fee changes of a domain registrar, hosting company, email provider, payment processor, SMS platform or any other third party.

9. Intellectual property

Once payment is received in full, you own the finished website content we deliver for that project — the layout, text you approved, and the compiled pages — and you keep all rights to your own name, logo, trademarks and materials.

We retain ownership of our pre-existing tools, code, templates, frameworks, processes and know-how, and of any general techniques developed while working on your project. We grant you a perpetual, royalty-free licence to use those elements as part of your live site.

You grant us permission to show your site in our portfolio and to name your business as a client, unless you tell us in writing not to.

10. SMS and text messaging compliance

Two Fifty Site, a DBA of Webmatic 247, sends and receives text messages only where consent has been given. When a visitor opts in through our SMS opt-in page, they are agreeing to receive SMS text messages from Two Fifty Site for customer communications, follow-up, and marketing. Message types may include service updates, follow-up on a request or enquiry, review requests, and occasional marketing offers.

Message frequency may vary. Msg & Data rates may apply. Reply STOP to unsubscribe. Reply HELP for help.

Consent is not a condition of any purchase. Carriers are not liable for delayed or undelivered messages. You may reply STOP at any time to cancel; opting out of marketing messages does not stop messages that are necessary to deliver a service you have requested, such as appointment confirmations, estimates or billing notices. We keep records of consent — the mobile number, the date and time, and the page it came from — for as long as needed to evidence compliance, and we process STOP and HELP requests promptly.

For details on how we collect, use and protect your mobile number and other personal information — including our commitment that phone numbers collected through SMS opt-in are never sold to third parties — see our Privacy Policy.

Where you use our follow-up system to message your own leads, you are responsible for holding a lawful basis to contact them and for making sure your messages comply with applicable law.

11. Confidentiality

Each party will keep the other’s non-public business information confidential and use it only to perform under this agreement. This does not cover information that is already public, that was lawfully known beforehand, or that must be disclosed by law.

12. Warranties and disclaimers

We warrant that our work will be performed in a professional and workmanlike manner. Beyond that, our services and website are provided “as is” and “as available.” We do not guarantee any particular result, including search engine rankings, traffic, enquiry volume, revenue, or the availability of any third-party service, and we make no other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose and non-infringement.

13. Limitation of liability

To the fullest extent permitted by law, Two Fifty Site will not be liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost leads, lost data or business interruption, even if advised of the possibility. Our total aggregate liability for any claim arising out of this agreement is limited to the greater of the fees you paid us in the three months before the claim, or $250 US.

Nothing in these Terms limits liability that cannot be limited under Virginia law.

14. Indemnification

You agree to defend, indemnify and hold Two Fifty Site and its contractors harmless from any claim, loss, damage or expense (including reasonable legal fees) arising from your content, your use of the site, your breach of these Terms, or your violation of any law or third-party right.

15. Relationship of the parties

Two Fifty Site is an independent contractor. Nothing in this agreement creates a partnership, joint venture, agency or employment relationship, and neither party may commit the other to anything.

16. Changes to these terms

We may update these Terms from time to time. The version published on this page at the time you place an order applies to that order, and material changes to a monthly plan will be notified to you by email or text before they take effect.

17. Governing law and disputes

These Terms are governed by the laws of the Commonwealth of Virginia, without regard to its conflict-of-laws rules. The parties submit to the exclusive jurisdiction and venue of the state and federal courts located in Virginia for any dispute arising out of this agreement. Before filing a claim, both parties agree to attempt in good faith to resolve the matter directly for at least 30 days.

18. General provisions

These Terms, together with your approved project summary, are the entire agreement about the services and replace earlier discussions. If any provision is found unenforceable, the rest continue in effect. A failure to enforce a provision is not a waiver of it. Neither party is liable for delay caused by events beyond its reasonable control. Any claims must be brought within one year of the event giving rise to them.

19. Contact us

Questions about these Terms can be sent to Two Fifty Site at info@250site.com or by replying to any text message you have received from us.
